CE Directives for toys

After the 20th of July, 2011 only the new Toys Directive 2009/48/EC is officially applicable to toys.

Companies who are involved in the manufacturing, importing and sales of toys, may use both the old Toys Directive 88/378/EEC and the new Toys Directive 2009/48/EC until 20th of July, 2011. After the 20th of July, 2011 only the new Toys Directive 2009/48/EC is officially obligatory in all EU Member States.

Modifications applicable to the Toys Directive 2009/48/EC

The most relevant modifications of the new Toys Directive 2009/48/EC are:

  • Limit values for heavy metals (lead, cadmium and mercury);
  • Chemicals that are susceptible to provoke cancer (CMR substances) are no longer allowed;
  • To avoid allergenic reactions, rules for allergenic substances and certain fragrances are specified;
  • More stringent and comprehensive standards for sound-emitting toys;
  • Carry out a risk assessment procedure;
  • Compliance with the essential safety requirements;
  • EC declaration of conformity including a photo and product number.

Economic operators according to the Toys Directive
The Toys Directive describes four economic operators: the manufacturer, the importer, the distributor and the authorised representative. Depending on the economic operator, specific requirements are applicable which are laid down in this new implemented Directive.
